Fees for Motoring Offences in the Magistrates Court

The type of motoring offences are:

  • Drink driving
  • Drug driving
  • Careless driving
  • Speeding
  • Failing to comply with notices of intended prosecution
  • Failing to stop
  • Failing to report
  • Driving without insurance, MOT or licence etc.

Unfortunately these matters do not generally attract Legal Aid unless there is a significant legal issue, or alternatively because of your personal history or the alleged facts of the case are so serious the court will consider custody. Each application for Legal Aid is based on your individual financial circumstances and the individual alleged facts.

In the event that you wish to pay privately on motoring offences, we do offer fixed fees for less complicated cases such as drink driving, careless driving and speeding. This is at a cost of £400.00 plus VAT, which includes case conference in person, review and analysis of the evidence and a single hearing if it is an intended guilty plea after review and advice. We can also offer fixed fees on motoring matters which are more complex. This will provide certainty of fees for you.

The fee does not include:
  • Instruction of any expert witnesses
  • Taking statements from any witnesses
  • Advice and assistance in relation to a special reasons hearing
  • Advice or assistance in relation to any appeal
The key stages of your matter are based on the presumption that you have entered a guilty plea and have a date for your hearing.
  • Meet with your solicitor to provide instructions on what happened.
  • We will consider initial disclosure, and any other evidence and provide advice.
  • If we deem it necessary to take any additional witness statements in your case we will provide you with an additional cost to that piece of work.
  • We will explain the court procedure to you so you know what to expect on the day of your hearing, and the sentencing options available to the court.
  • We will conduct any further preparatory work, obtain further instructions from you if necessary and answer any follow up queries you have.
  • We cannot provide a timescale of when your hearing will take place, as this depends on the court listing for that day.
  • We will attend court on the day and meet with you before going before the court.
  • We will discuss the outcome with you. If advice is required on appeal, this will carry an additional cost.
